On December 13, 2024, the NC Supreme Court released its long-awaited opinion in Sturdivant v. NC DPS. This case involves the interpretation of G.S. 97-29( c ), the “Extended Benefits” portion of the Temporary Total Disability statute. Both the Industrial Commission and workers’ comp practitioners have been waiting on this decision, so that all have guidance on determining eligibility for extended benefits for the most seriously injured workers under the 2011 Workers’ Compensation reforms. In this short seminar the attorneys who litigated this case at the Commission and through the appellate courts will share their insights in an interactive panel discussion with attendees as to what the Commission and Courts will require to award extended benefits in light of this decision.
